Terms of Service for Plai.

1. Acceptance of Terms

By downloading, installing, or using Plai. (the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

Plai. is an audio-first digital journaling app that lets you create, store, and optionally synchronize personal entries, including text and voice recordings. The Service consists of the iPhone app and a companion backend that authenticates accounts via Sign in with Apple and routes AI requests (voice transcription, embeddings, and Plai. Insights) to OpenAI on your behalf. The Service may also include optional features such as biometric authentication and integration with Apple’s iCloud for backup and sync.

2. Use of the Service

You agree to use the Service only for lawful, personal, and non-commercial purposes and in accordance with these Terms.

To use AI-powered features of the Service (voice transcription, search, and Plai. Insights), you must sign in with Apple. We do not store your Apple ID password or any other credentials — only the identifiers described in our Privacy Policy. You are responsible for maintaining the security of your device and your Apple ID, and for managing your data, including local storage and iCloud settings.

3. Subscriptions, Trials, and Billing

Plai. offers optional paid features through the Plai. Plus subscription. Subscriptions are billed through Apple’s App Store in accordance with its payment terms. By subscribing, you authorize Apple to charge the applicable fees (including taxes) to your selected payment method. Subscriptions automatically renew until cancelled. You can manage or cancel your subscription at any time via your Apple ID account settings; cancellations take effect at the end of the current billing period. Subscription fees are non-refundable except where required by law.

Free Trial: Eligible new subscribers may receive a 14-day free trial. Trial access includes up to 30 AI-powered analyses and 60 minutes (3,600 seconds) of voice recording time. If you reach either limit or the 14-day period ends, whichever comes first, trial access ends and premium features will pause until you subscribe.

Subscription Usage Caps: Plai. Plus plans include reasonable per-period usage limits to preserve service quality. Monthly subscriptions allow up to 300 analyses and 36,000 seconds (10 hours) of voice recordings per billing cycle, while yearly subscriptions allow up to 3,600 analyses and 432,000 seconds (120 hours) per cycle. These meters reset at the start of each new paid period; exceeding a limit will pause access to the affected premium features until the period resets or you move to a higher tier.

We may adjust trial availability, duration, or usage limits (including for subscribers) and will communicate material changes within the app. We reserve the right to revoke or shorten a trial if we detect fraud, abuse, or violation of these Terms.

4. User Content

You retain full ownership of all content you create within the Service, including text entries, audio recordings, transcripts, and any other materials (“User Content”).

If you enable optional features such as iCloud synchronization, your User Content will be stored in your personal iCloud account using Apple’s infrastructure. When you use AI features, the relevant User Content (audio for transcription, or text passed as context for a question) briefly passes through our backend on its way to OpenAI and is not retained on our servers after the response is returned. You are solely responsible for ensuring that your User Content complies with all applicable laws and regulations.

5. Intellectual Property

All intellectual property rights in the Service, including its design, user interface, source code, and branding, are owned by Plai. or its licensors.

You may not copy, reproduce, modify, distribute, or reverse engineer any part of the Service without our prior written permission.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how your data is handled, including local device storage, iCloud integration, and third-party AI processing via OpenAI.

We do not collect any personally identifiable information. All journal data remains private and under your control.

7. Termination

We may suspend or terminate your access to the Service at any time and without notice if you violate these Terms or use the Service in a way that causes harm to us or others.

You may discontinue use of the Service at any time. You can also delete your account and all associated backend data from inside the app, which immediately removes your user record and rate-limit counters from our database. Upon termination, provisions related to intellectual property, disclaimers, and limitation of liability shall remain in effect.

8. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted or error-free, or that any content will be preserved or recoverable in all circumstances. AI-generated insights are intended as a reflection aid, not as medical, psychological, legal, or financial advice.

9. Limitation of Liability

To the maximum extent permitted by law, Plai. and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

In any case, our total liability to you will not exceed the amount you have paid, if any, to use the Service.

10. Changes to the Terms

We may update these Terms from time to time to reflect changes in technology, legal requirements, or our business practices. When we do, we will revise the “Last Updated” date above. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
